CAVEAT EMPTOR – Let the buyer beware

Commercial property doesn’t have the same safeguards as residential properties. There are generally no consumer protection act laws to help a commercial buyer. Commercial properties are considered, “as is where is”.Personally, I like it that way. My experience is that the more regulators get involved, the worse the situation becomes. The consumer is rarely helped, and quite often is actually hurt (can anyone say ” Texas Lease Option Law”). Everything gets more expensive and time-consuming. Honest investors are restricted more, while the crooked ones just find another way to “screw the pooch” and keep on stealing.

I’m all for nailing crooks. In fact, I’m willing to help. I just don’t think over-regulation is the answer.

So in the commercial world, due diligence takes on added importance, not only because of the less so-called “protection” (hallelujah!), but also because the numbers are bigger, and the deals are more complicated.

The Process of Due Diligence

Due diligence is all about validating facts, eliminating assumptions and digging up more information about your investment. It’s the only way to protect yourself, and the only way to assure the best deal possible.It’s a process. And “The Process of Thorough Due Diligence” is the topic covered by our first speaker, Ann-Marie Daleo, CCIM.

Ann-Marie brings a wealth of knowledge and experience as an advisor on all types of commercial real estate projects. Ms. Daleo has more than 12 years of commercial real estate advisory experience and has a proven track record in both transactional and operational roles and in servicing a variety of clients including private equity groups, CMBS lenders, note buyers, private investors and corporations. Winning The Seller Over by Tom Berry

How would you like to have the ability to meet someone for the first time, and within 5 minutes (or less), know how and what he is likely thinking, and exactly how to approach him to get what you want in a negotiation? Would that give you an almost unfair advantage over your competition? Would that skill allow you to close more deals more easily? You bet it would!That’s the skill Tom Berry is going to teach you at The Wealth Club Saturday.

You see, most negotiators assume all Sellers are alike. Worse yet, they assume the Seller is just like them. Too often, investors end up “negotiating with themselves”, hitting all the points that appeal to them, using language and strategies that they respond to, blind to the fact that his approach may not appeal to that particular Seller at all, and may even turn him off.

Why? Because people, including the Sellers you negotiate with don’t come “one size fits all”. They are unique personalities and will react completely differently, depending of which personality type they are. It has nothing to do with their current motivation or situation. It has everything to do with who they are.

They’ve had their basic personality since childhood. It’s colored how they react to the world and to other people (you) and what and who they are comfortable with. If you’re going to reach them and connect with them, you better be able to recognize “who they are and what makes them tick” right away.

 

Fortunately The Solution is Easy

Luckily, personalities tend to fall into one of four distinct types. Each personality type is very recognizable once you’re trained. And each type is extremely predictable as to how it responds, what makes him comfortable (or not so comfortable), body language, and so forth.The good news is that this is a skill that you can, and should, learn. And I’ve asked fellow investor Tom Berry to spend about an hour at The Wealth Club Saturday showing you

  • The four basic personality types
  • How to identify which type your Seller is in five minutes or less

Just a couple of days ago Tom was talking to a Seller. He was motivated. Tom’s offer made perfect sense, yet the Seller kept balking. Suddenly it dawned on Tom that one thing he was doing made the Seller uncomfortable (you don’t do this with T-type personalities). He changed one thing in his approach, and the Seller’s hesitation melted away. Tom eventually closed the deal without changing his offer one iota.
